Information Processed on Behalf of Our Clients

As a platform provider, Bectify processes data on behalf of our clients (service businesses). This includes lead information, conversation transcripts, appointment data, and customer contact details that flow through our AI automation system. We process this data solely according to our client's instructions and our Data Processing Agreement.

• Service providers — Third-party tools that help us operate our platform (e.g., Supabase for database hosting, Vercel for web hosting, Anthropic for AI processing, Twilio for communications, GoHighLevel for CRM)
• Our clients — Data collected through our AI automation system is shared with the client business that the end customer contacted
• Legal requirements — When required by law, subpoena, or court order

4. AI and Automated Processing

Bectify uses artificial intelligence to process conversations, extract lead information, and generate responses on behalf of our clients. Specifically:

• Inbound SMS and chat messages are processed by AI (Claude by Anthropic) to qualify leads and capture contact information
• Voice calls are processed by AI (Retell AI) to handle conversations and book appointments
• Conversation transcripts are analyzed to extract structured data (name, phone, address, service type, etc.)
• AI-generated responses are sent to end customers on behalf of our clients

All AI processing is performed to fulfill our clients' service delivery needs. End customers are interacting with our clients' businesses, not with Bectify directly.

5. Text Messages & Phone Communications

Program Name: Bectify Client Communication Platform

Description: Bectify sends SMS and voice communications on behalf of our client businesses to their end customers. Messages include service inquiries, appointment confirmations, reminders, follow-ups, and review requests.

Message Frequency: Varies based on the service interaction. End customers may receive between 1 and 20 messages per conversation.

Message & Data Rates: Standard message and data rates may apply.

Opt-Out: End customers may opt out at any time by replying STOP to any message.

Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchasing any goods or services.

6. Data Security

We implement industry-standard security measures to protect data:

• All data is encrypted in transit (TLS/HTTPS)
• Database access is secured with Row-Level Security policies
• API credentials and tokens are encrypted at rest
• Per-client credential isolation (separate Twilio subaccounts, separate CRM API keys)
• Admin access requires authentication with role-based permissions

No method of transmission over the Internet is 100% secure. We cannot guarantee absolute security.

7. Data Retention

We retain data for as long as necessary to provide our services:

• Account data — retained while your account is active
• Conversation data — retained per client agreement (typically 12 months)
• System logs — retained for 90 days
• Billing data — retained as required by law

By accessing or using the Bectify platform, website (bectify.com), or any services provided by Bectify LLC ("Bectify," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

Bectify provides an AI-powered automation platform for service businesses. Our services include:

• AI-driven lead capture and qualification via SMS, voice, and webchat
• Automated appointment scheduling and reminders
• CRM integration and contact management
• Nurture sequence automation
• Review management
• Client portal and dashboard
• Website generation and hosting

3. Account Registration

To use our platform, you must:

• Provide accurate and complete business information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Have the authority to bind your business to these terms

You are responsible for all activity that occurs under your account.

4. Subscription & Billing

Bectify services are offered on a monthly subscription basis. By subscribing, you agree to:

• Pay the monthly fee associated with your selected tier
• Pay any applicable setup or onboarding fees
• Provide valid payment information
• Accept that fees are non-refundable unless otherwise stated in your service agreement

We reserve the right to modify pricing with 30 days' written notice.

5. Acceptable Use

You agree not to:

• Use our platform to send spam, unsolicited messages, or messages that violate TCPA, CAN-SPAM, or other applicable regulations
• Misrepresent your identity or the identity of your business
• Use the platform for any illegal purpose
• Attempt to reverse-engineer, decompile, or access the source code of our platform
• Interfere with or disrupt the platform's operation
• Share account credentials with unauthorized parties

6. SMS & Communication Compliance

As a user of our communication features, you are responsible for:

• Obtaining proper consent before sending messages to your customers
• Complying with all applicable telecommunications laws (TCPA, CTIA guidelines, A2P 10DLC requirements)
• Maintaining accurate opt-in records
• Honoring opt-out requests immediately

Bectify provides the tools for compliant messaging, but you are ultimately responsible for how you use them.

7. Data Ownership

• Your data: You retain ownership of all business data, customer information, and content you provide to or generate through our platform
• Our platform: Bectify retains ownership of the platform, software, AI models, workflows, and all intellectual property
• Data portability: Upon account termination, you may request an export of your data within 30 days

8. AI-Generated Content

Our platform uses artificial intelligence to generate responses, analyze conversations, and automate workflows on your behalf. You acknowledge that:

• AI-generated responses are sent on behalf of your business, and you are responsible for their content
• AI may occasionally produce inaccurate or unexpected responses
• You should review and adjust AI behavior through the block configuration system
• Bectify is not liable for actions taken by end customers based on AI-generated communications

9. Service Level & Uptime

We strive to maintain high availability but do not guarantee 100% uptime. We are not liable for service interruptions caused by:

• Third-party service outages (Twilio, Retell AI, GoHighLevel, Supabase, etc.)
• Scheduled maintenance (announced in advance when possible)
• Force majeure events

10. Limitation of Liability

To the maximum extent permitted by law, Bectify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost leads, missed appointments, or data loss arising from your use of our services.

Our total liability shall not exceed the amount you paid to Bectify in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Bectify, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the platform, your violation of these terms, or your violation of any law or regulation.

12. Termination

• By you: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• By us: We may suspend or terminate your account for violation of these terms, non-payment, or at our discretion with 30 days' notice.
• Effect: Upon termination, your access to the platform will cease. You may request a data export within 30 days.

13. Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of El Paso County, Texas.

14. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or platform notification. Continued use of our services after changes constitutes acceptance of the updated terms.
